5th Circuit Puts Mothers & Children in Jeopardy by Allowing Distribution of Abortion Pill
National Pro-Life Group Calls for the Supreme Court to Intervene
Washington, DC – Today, the 5th Circuit Court of Appeals ruled on the appeal made by the federal government to the district court decision which was set to put the dispensation of the abortion pill on hold nationwide.
Lila Rose, founder and president of Live Action released the following statement:
“The abortion pill has killed 5.6 million American children and harmed countless mothers with at least 28 associated maternal deaths. Judge Kacsmaryk was absolutely right when he ruled that the abortion pill was approved illegally. The FDA did not conduct their standard due diligence when they approved this dangerous drug by classifying pregnancy as a life-threatening condition. Pregnancy is a completely natural and healthy state for a woman, and it is irresponsible and dangerous to treat pregnancy like a disease. The 5th Circuit has made a mistake by allowing this deadly drug to be prescribed while litigation continues.”
The 5th Circuit has recently reined in some of the most recent and egregious mistakes the FDA has made in regards to mifepristone, including:
- Reinstating the gestational age limit during which the drug can be used to 7 weeks
- Restoring the requirement for three in-person visits to the abortion provider
- Stopping non-physicians from prescribing the drug and pharmacies from dispensing
- Requiring reporting of all adverse medical events related to the pill.
The 5th Circuit also ruled that the FDA’s approval of generic mifepristone was unlawful, and that the manufacturer (GenBioPro) must cease production by this Friday, April 14. Although these are steps in the right direction, they are not nearly enough to ensure mothers and children are protected from this drug, which is intended to kill a living human being with a beating heart.
The Biden administration said Thursday it will ask the Supreme Court to intervene to expand access to the abortion pill mifepristone, including through mail orders and without having to visit a doctor.
Rose continued, “I plead that the United States Supreme Court take up this appeal and reinstate Judge Kacsmaryk’s reasoned and just ruling stopping the distribution of the most dangerous drug in America. Although the pro-abortion media wants to convince the American people otherwise, it’s clear that this drug’s only intention is to end the life of a child and harm a mother. It must be eliminated from use and no longer be accessible.
The FDA and the federal government as a whole must vigorously support the 5th Circuit ruling as it pertains to mail-order abortions in order to save America’s women and children from this culture of death.
The Biden Administration is grossly misguided about this lethal drug, putting our women and children at grave risk. The government must use every power and resource at its disposal to fight this evil infiltrating our country and begin to seize and shut down websites that are trafficking dangerous abortion drugs including Mayday and Aid Access. We will not accept anything less then a full closer of these traffickers. We will not stop until the abortion pill is completely off the market and the government does their job of ensuring every human being is given equal protection under the law.”
