SCOTUS Ignores Abortion Pill Crisis in Procedural Decision
Washington, D.C. – Today, the United States Supreme Court released a decision in Food and Drug Administration et al. v. Alliance for Hippocratic Medicine et al. based purely on procedural grounds, declining to rule on the merits of the case.
Lila Rose, founder and president of Live Action, released the following comment:
Abortion pills kill children – approximately 646,815 per year, 53,901 per month, 1,772 per day, 74 per hour, and 1 per minute within the formal healthcare system alone, according to the most recent national estimates available. The abortion pill is now the most prevalent form of the lethal violence we call abortion, with over 60% of abortions estimated to be committed via the abortion pill. Our nation faces a crisis caused by the abortion pill and the Biden administration’s reckless actions to make the drug widely available and to reduce oversight as much as possible. The Supreme Court had an opportunity to respect the rule of law and rein in the Biden administration’s most egregious recent actions, including its decision to allow the abortion pill to be illegally shipped through the mail without an in-person doctor visit. It is regrettable that the Court declined to rule on that issue.
The Biden administration FDA’s unlawful and dangerous expansion of the abortion pill will continue to kill children and endanger their mothers because of the Supreme Court’s inaction. The Court did not consider the merits of this case; every other federal court that has reviewed the case’s merits has found that the Biden administration acted illegally in their abortion pill expansion. Instead, the Court ruled on purely procedural grounds, finding that the doctors who challenged the rules lack standing because they do not perform abortions.
The abortion pill crisis will continue, as almost 2,000 children are killed by this method every single day. The Supreme Court cannot ignore this forever. Abortion pills will be back in court soon, as multiple state attorneys general have joined the challenge to the Biden administration’s reckless rules. Data shows that 63% of Americans oppose allowing the distribution of chemical abortion drugs through the mail instead of having women get them in person from a specially certified health provider. Yet even stronger safety measures are not enough; our abortion pill crisis will not end until drugs that kill children are pulled from the market, whether by the Supreme Court or the next president.
