On Monday, August 1, the Kentucky Court of Appeals removed a temporary injunction that had blocked the state’s Human Life Protection Act and Heartbeat law from going into effect. These provisions will — for now, at least — protect nearly all preborn children from abortion in the state.
On July 22, Jefferson Circuit Court Judge Mitch Perry issued a temporary injunction against the two pro-life laws. Though Kentucky Attorney General Daniel Cameron filed an appeal, according to a previous report from Live Action News, “the Supreme Court denied his request to overturn Perry’s ruling.”

“The Kentucky Court of Appeals late Monday night approved Cameron’s request for emergency relief, which he filed Friday,” reported the Lexington Herald-Leader. “The Attorney General, who’s running for governor, asked the court to reinstate his ability to enforce the state’s trigger law, which bans all abortions except in cases of where death or substantial risk of death of the pregnant person exists, as well as a six-week ban on abortions.”
The Associated Press added, “The appeals court said the ban should take effect, even if the laws are in dispute, because in Kentucky, ‘a statute carries with it the presumption of constitutionality.'”
The Planned Parenthood Great Northwest, Hawai’i, Alaska, Indiana, Kentucky affiliate is directing women out of state for abortions, tweeting that Kentucky’s pro-life protections are “cruel and devastating.”
AG Cameron tweeted in response to the decision, “Today the Court of Appeals granted our motion to have the Kentucky Human Life Protection Act and the Heartbeat Law reinstated in the Commonwealth. I appreciate the court’s decision to allow Kentucky’s pro-life laws to take effect while we continue to vigorously defend the constitutionality of these important protections for women and unborn children across the Commonwealth.”
