(LifeSiteNews) – As pro-life activists across the country pursue a legislative strategy they hope will finally overturn Roe v. Wade, several Democrats running for president have endorsed national legislation to take abortion out of the states’ hands entirely.
Following numerous states that have passed bans on abortion once a fetal heartbeat can be detected, Alabama and Georgia recently signed new laws that ban the vast majority of abortions. Supporters hope the wave of more aggressive pro-life laws will provoke enough legal challenges to eventually reach the U.S. Supreme Court and overturn its 1973 ruling, restoring the ability of every state to set its own abortion laws.
After former Vice President Joe Biden called the latest pro-life laws “pernicious” and “wrong” Tuesday, his campaign said he would support federal legislation to codify Roe “should it become necessary,” the Associated Press reported, with an aide soon following up that Biden would support such a bill “immediately,” without waiting for the Supreme Court to decide Roe’s fate.

Also on Tuesday, Texas Rep. Robert “Beto” O’Rourke vowed at a CNN town hall to work with Congress “to make sure that by statute we prevent states from taking away the right that every woman should enjoy,” alongside holding a litmus test for pro-abortion judicial nominees and reversing current executive restrictions on taxpayer funding of abortion.
The exact form such legislation would take remains to be seen, but pro-abortion activists have long advocated that Congress pass the Freedom of Choice Act (FOCA) and Women’s Health Protection Act (WHPA), which would federally nullify a broad range of pro-life measures and forbid states from enacting even modest abortion restrictions.
The AP noted that several other Democrats vying for the 2020 nomination, including U.S. Sens. Kirsten Gillibrand, Cory Booker, Elizabeth Warren, and Kamala Harris have already endorsed enshrining abortion “rights” in federal law. Also on Tuesday, Sen. Bernie Sanders reiterated his past support for bills such as FOCA and WHPA.
Every current Democrat presidential candidate is running as uncompromisingly pro-abortion; each of them currently in the U.S. Senate also voted against giving basic medical treatment to infants who survive failed abortions.
