Man sentenced to prison for deaths of woman, son, and preborn baby in car accident

A Wisconsin man has been sentenced to three years in prison for the deaths of a woman, her one-year-old son, and her preborn child in a 2022 car crash.

According to the Washington County Daily News, Steven Bruskiewicz was sentenced last week by Washington County Circuit Judge Michael S. Kenitz after he was found guilty of four felony charges, including two for homicide by negligent operation of a vehicle, one for homicide of an unborn child by negligent operation of a vehicle, and one for driving recklessly causing great bodily harm.

Bruskiewicz told police after the accident that he had been using social media on his phone when the crash happened.

According to reports, Casey Lynn Schwartz was driving south on Highway 164 when she was rear-ended and pushed into oncoming traffic. Schwartz, her son Octavius, and her preborn baby Earl were all killed in the crash.

Family members of Schwartz gave statements in court about her and her babies.

Her husband, also named Casey, said, “Shoes, toys, pictures, memories — I don’t really touch any of that because it hurts too much.” He added, “I lost my entire world in a matter of seconds because of one person’s decision to look at his phone while driving.”

“Life simply sucks without Casey and Octavius,” said Courtney Grier, Schwartz’s sister. “We were supposed to be first-time moms together.”

Under Wisconsin law, anyone who causes the death of another person due to negligent operation or handling of a vehicle is guilty of a Class G felony, including if the person is a preborn baby. A Class G felony carries a punishment of up to 10 years in prison and a $25,000 fine. However, Wisconsin law also states that anyone “who intentionally destroys the life of an unborn child is guilty of a Class H felony,” which carries up to six years in prison and a fine of up to $10,000. Intentionally killing a preborn child against the mother’s will carries less severe punishment in Wisconsin than causing the preborn child’s death through negligence.

That law specifically states that it does not apply to the mother of the child, who is allowed to intentionally cause the death of her preborn baby by abortion. Intentionally killing a preborn child through abortion is legal in Wisconsin through 21 weeks and six days with an exception after that time to save the life of the mother, though it is not necessary to intentionally kill a preborn child to save the mother’s life.

According to CBS, Bruskiewicz Jr. told the court, “This is without a doubt the most regrettable moment in my life.”
