On June 17, 2022, the Supreme Court of Texas announced it will hear cases concerning pro-lifer Mark Lee Dickson and Right to Life East Texas. The court will hear two cases: The Lilith Fund for Reproductive Equality v. Mark Lee Dickson and Right to Life East Texas, and Mark Lee Dickson and Right to Life East Texas v. The AFIYA Center and Texas Equal Access Fund.
As previously reported by Live Action News, the case claims that Mark Lee Dickson, the Director of Right to Life of East Texas and Founder of the Sanctuary Cities for the Unborn Initiative, defamed the Lilith Fund with his comments concerning their billboard which boldly stated, “Abortion is Freedom.” Dickson remarked in response that abortion is “murder” and “criminal,” referring to pre-Roe Texas laws that, while not currently in effect, have never been repealed.
In response to the accusations against him, Dickson said, “The Lilith Fund and other abortion-aiding organizations all take part in the murder of innocent unborn human beings. The statements which I have made are rooted not in my own imagination, but in the law written on all of our hearts, in the Constitution of the United States of America, in the Texas Constitution, and in the laws of the great State of Texas.”

In September 2021, the 7th District Court of Appeals in Texas ruled in a 3-0 decision in favor of Mark Lee Dickson against the Lilith Fund, a pro-abortion organization that says it “helps people pay for abortions when they can’t afford it.” The district court determined that Dickson’s words were constitutionally protected, saying the comments the case was based upon were “inactionable.” It was also decided that the Lilith Fund would be responsible for all of Dickson’s court costs and attorney fees.
On Friday, Dickson shared the news that the Supreme Court of Texas will hear the cases and, tweeting, “Abortion is murder. The abortion industry is involved in murdering children, and none of us should fear a defamation lawsuit for stating these truths.”
